Terms of Service

The Site is intended for members of the public seeking to find and contact Listed Businesses for genuine, personal enquiry purposes. You may use the Site only for lawful purposes and in accordance with these Terms.

By using the Site you warrant that the information you provide is accurate, that you are legally capable of entering into a binding agreement, and that you will not use the Site on behalf of any competing directory, data broker, or aggregator.

You may view listings and use the contact details of a Listed Business solely to make a bona fide, individual enquiry with that specific business about its services. Any other use of the information on the Site is prohibited unless we give our prior written permission.

You must not, and must not permit or assist any other person to:

• Scrape, crawl, spider, harvest, index, mine, extract or systematically download any content, data, listings or contact details from the Site, whether manually or by any automated means, script, bot or software;
• Copy, reproduce, duplicate, compile, republish, store, resell, licence, distribute or otherwise exploit any part of the Site or its listings, including any telephone numbers, WhatsApp numbers, email addresses or other contact details of Listed Businesses;
• Collect or compile telephone numbers or other contact details of Listed Businesses into any list, database or record, or use them for bulk, automated, marketing, advertising, promotional, sales, spam or solicitation purposes;
• Contact any Listed Business for any purpose other than a genuine enquiry about that business's services — in particular, you must not use the Site to market to, solicit, recruit, spam, or sell to Listed Businesses;
• Harass, abuse, threaten, stalk, defame, disparage, intimidate or cause nuisance or harm to any Listed Business, its owners, staff or representatives, whether through the Site, by telephone, messaging, email, review or otherwise;
• Post, submit or transmit any content (including reviews) that is false, misleading, defamatory, harassing, obscene, discriminatory, unlawful, or that you know to be untrue;
• Impersonate any person or business, or misrepresent your identity or affiliation with any person or business;
• Use the Site or any data obtained from it to build, populate, train, benchmark or improve any competing directory, database, dataset, mailing list or machine-learning model;
• Circumvent, disable, probe or interfere with any security, access control, rate limit, robots directive or other technical measure of the Site;
• Introduce any virus, malware, or harmful code, or take any action that imposes an unreasonable load on, disrupts, degrades or impairs the Site or its infrastructure (including denial-of-service activity);
• Frame, mirror, deep-link in a misleading way, or remove, obscure or alter any proprietary notice, branding or attribution on the Site; or
• Use the Site in any way that is unlawful, fraudulent, or that infringes the rights of, or restricts or inhibits the use of the Site by, any other person.

All content on the Site, including its selection, arrangement, compilation and presentation of listings, together with the Site name, branding, text, graphics, layout and software, is owned by or licensed to the Operator and is protected by copyright and other intellectual-property and database rights. The compilation of listings is a protected database; no part of it may be extracted or re-utilised without our prior written consent.

Nothing in these Terms grants you any right, title or interest in the Site or its content other than the limited right to use it in accordance with these Terms.

Listed Businesses are independent third parties. We do not employ, endorse, guarantee, warrant or assume responsibility for any Listed Business, or for the quality, safety, legality or suitability of any services they offer. Any dealing between you and a Listed Business is solely between you and that business, and you rely on any listing at your own risk. You should satisfy yourself as to the suitability and credentials of any Listed Business before engaging them.

If you submit a review or other content, you confirm it is your own genuine, honest opinion or experience, is not false or defamatory, and does not infringe any third party's rights. You grant us a non-exclusive, royalty-free, worldwide licence to host, moderate, display, edit for length and remove such content. We may decline, moderate or remove any submission at our discretion, and submissions are not published until moderated.

The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranties or representations, express or implied, regarding the Site or its content, including any warranty of accuracy, completeness, currency, fitness for a particular purpose, or uninterrupted or error-free operation.

To the fullest extent permitted by law, the Operator will not be liable for any indirect, incidental, special, consequential or punitive loss or damage, or for any loss of profits, revenue, data or goodwill, arising out of or in connection with your use of (or inability to use) the Site, your dealings with any Listed Business, or any reliance on any content on the Site. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.

You agree to indemnify and hold harmless the Operator against any claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site or any data obtained from it, or your infringement of any right of any Listed Business or other third party.

We process personal information in accordance with applicable data-protection law, including the Protection of Personal Information Act, 2013 (POPIA). We collect only the information needed to operate the Site and to record agreement to these Terms and any related undertakings, and we do not sell personal information. Contact details published on the Site belong to the relevant Listed Business and are provided solely to enable individual enquiries — any other collection or use of them is prohibited under clause 3.

We may restrict, suspend or terminate your access to the Site at any time, without notice, if we reasonably believe you have breached these Terms. We reserve all rights and remedies available to us in law, including seeking urgent interdictory relief and damages for any prohibited scraping, data misuse, harassment or defamation.

We may amend these Terms from time to time by posting the updated version on the Site. The updated Terms take effect when posted, and your continued use of the Site constitutes acceptance of them.

These Terms are governed by the laws of the Republic of South Africa, and you submit to the jurisdiction of the South African courts.
